    Taiwan Group Protests Heated Tobacco Regulations

    The Clean Air Alliance has called on the Taiwanese public to join a protest in front of the Presidential Office Building in Taipei March 22, 2024, against heated tobacco regulations that  benefit traditional cigarette manufacturers, reports The Taipei Times.

    The group states that though its been a year since the Tobacco Hazards Prevention Act was amended, heated-tobacco products cannot be sold legally but 14 new types of traditional paper-wrapped cigarettes have been approved for sale.

    The alliance noted that the review standards for heated-tobacco products and traditional cigarettes are disparate and unfair toward heated-tobacco products, which benefits cigarette manufacturers.

    Police have put traffic restrictions in place in the area due to the protest.

    The protest is set to begin at 9 a.m. and end by noon.

    Cigarette manufacturers in Russia produced 182 billion cigarettes in 2023, reports CRPT, which operates the Honest Mark product labeling system. Accounting for 87.7 percent of domestic tobacco production, cigarette manufacturing was largely stable (up 1 percent) from the previous year.

    Production of heated tobacco products, by contrast, jumped 26 percent to 1 billion packs, claiming 10 percent of the Russian tobacco market in 2023. Output of oral tobacco products more than doubled to over 5.8 million. Production of cigarillos increased to 61.5 million packs in 2023 from 32 million in 2022.

    The only categories of tobacco products whose production decreased in 2022-2023 were cigars and smoking tobacco, according to CRPT. The production of cigars fell by 38 percent to 4.2 million packs, and smoking tobacco decreased by 8 percent to 1.3 million packs.

    Domestic tobacco companies manufactured 96.6 percent of the nicotine products on the Russian market in 2023.

    Following Russia’s 2022 invasion of Ukraine, leading international nicotine companies, such as British American Tobacco and Imperial Brands have sold their operations to domestic investors.

    The multinationals that remain are finding it increasingly difficulty to extract themselves from the market due to onerous government restrictions on such transactions.

    BAT’s Italian division has been fined €6 million ($6.4 million) for “misleading advertising of a heated-tobacco product,” according to Barron’s. Amazon was fined €1 million for the same reason.

    According to the AGCM watchdog, BAT and Amazon advertised the Glo Hyper X2 and Glo Hyper Air devices without making “information about the tobacco/nicotine consumption connected to the use of these devices and the prohibition of their sale to minors” clear.

    The products were marketed “as simple electronic devices and mere design objects,” the watchdog said.

    “This is seriously misleading conduct, which induces the customer to buy a product that poses health risks and is banned for minors,” the authority said.

    An investigation into the marketing of the heated-tobacco products began in April 2023.

    BAT plans to appeal the fine, according to Bloomberg.  

    “We are clear that our products are for adults only, and we adhere to the highest standards of conduct to prevent underage use of any nicotine product,” a BAT Italia spokesperson said. “We cooperated with Italian authorities and implemented all suggested changes to our marketing immediately. While we acknowledge the decision, we plan to appeal.”

    BAT has launched a new version of its Glo heating device. Glo is an alternative to smoking that doesn’t involve burning, producing fewer and lower levels of toxicants than conventional cigarettes.

    The Glo Hyper Pro device is lightweight, fits easily in consumers’ pockets and comes with improvements in performance, according to the company. With this new device, one charge takes approximately 90 minutes and lasts all day. Once charged, consumers can expect to use the device for 20 sessions in total.

    “We’re proud that today, over 8.8 million adult consumers now use Glo,” said Kingsley Wheaton, chief strategy and growth officer at BAT, in a statement. “This latest version is our most advanced yet, with a much improved user experience. We continue to listen to consumers and enhance our products so that they find Glo a satisfying alternative to continuing to smoke. Ultimately, BAT aims to support smokers to switch to these reduced-risk products in order to deliver benefits for consumers, society and our stakeholders.”

    The wider Glo range is sold in over 20 markets around the world. The Glo Hyper Pro device has been launched in Japan, Italy and Poland, with further global market rollouts planned during 2024.

    Japan Tobacco announced the launch Ploom X Advanced, a new model of heated tobacco device that has evolved in terms of taste and user comfort.

    The company believes the new device will play a significant role in its mid- to long-term business strategy.

    According to JT, the new device represents a significant improvement over the current model and incorporates advanced features, including:

    • An upgraded heating technology, dubbed “Power Heatflow,” which increases the maximum heating temperature from 295 degrees Celsius to 320 degrees Celsius to provide a richer flavor experience.
    • A new automatic heating function that automatically starts heating when a stick is inserted into the device.
    • Reduced charging time from approximately 110 minutes for the current model to approximately 90 minutes.

    The device will be available at convenience stores and tobacco retailers nationwide in Japan starting on Nov. 21, 2023, at a suggested, tax-included retail price of ¥1,980 ($13.22).

    Following the launch of Ploom X Advanced, JT will discontinue sales of the current Ploom X model in Japan.

    Philip Morris International Oct. 20 submitted premarket tobacco product applications (PMTAs) and modified risk tobacco product applications (MRTPAs) for IQOS Iluma heated tobacco products with the U.S. Food and Drug Administration (FDA).

    IQOS Iluma products are PMI’s most-innovative heated tobacco products. They deliver substantially similar reductions in the formation of harmful and potentially harmful constituents as earlier versions of IQOS products authorized by FDA

    According to PMI, IQOS Iluma has demonstrated higher rates of full switching by adults who smoke and improved consumer satisfaction in many countries.

    IQOS Iluma products rely on a fundamentally different heating technology from previous versions of IQOS products and contain numerous technological advancements including improved device and battery longevity.

    IQOS Iluma products are currently available in 27 markets internationally

    PMI’s applications are supported by a thorough scientific assessment, including aerosol chemistry, in vitro toxicology, a pharmacokinetic study, and consumer perception and behavior studies, as well as the comprehensive scientific dataset generated with previous versions of the IQOS system

    The IQOS Iluma devices operate on the Smartcore Induction System that heats tobacco from within Terea Smartcore Sticks—heated tobacco sticks designed to be used only with IQOS Iluma devices

    PMI has submitted applications for three Iluma devices and five variants of the tobacco sticks: Terea Blue, Terea Green, Terea Sienna, Terea Bronze, Terea Amber

    PMI will have the full rights to commercialize all IQOS products in the U.S. as of April 30, 2024, per the terms of an agreement with Altria Group, Inc. ending the companies’ commercial relationship covering IQOS in the U.S.

    Last month, the Romanian Government enacted Governmental Ordinance No. 23/20.07.2023 amending and supplementing the Romanian Tobacco Law (GO 23). The move bans all flavored heated tobacco products.

    The law takes effect on Oct. 23, 2023.

    Prior to enacting GO 23 under the framework of Romanian Tobacco Law, only cigarettes and roll-your-own tobacco were subject to the prohibition of having a characterizing flavors and containing flavorings in any of their components such as filters, papers, packages, capsules or any technical features.

    The aim of GO 23 is to extend this prohibition to heated tobacco products and to impose more restrictive requirements on packaging and labelling of such heated tobacco products, according to media reports.

    For the first time, GO 23 enacts a legal definition of “heated tobacco products” which refers to “a novel tobacco product that is heated to produce an emission containing nicotine and other chemicals, which is then inhaled by user(s), and that, depending on its characteristics, is a smokeless tobacco product or a tobacco product for smoking.”

    This definition will include any type of vaping devices that entail heating of tobacco in view of obtaining an inhalable emission containing nicotine and other chemicals.

    Heated tobacco products with any type “characterizing flavor”, such as menthol, fruits, etc., will no longer be allowed in the Romanian market.

    Additionally, each unit of and any outside packaging of heated tobacco products must carry the mandatory information message: “Tobacco smoke contains over 70 substances known to cause cancer.”

    GO 23 also states that each unit packet and any outside packaging of heated tobacco products for smoking must carry combined health warnings that observe all the requirement set out in Art.

    All producers and importers of heated tobacco products in Romania must notify the Romanian Health Ministry within 90 days after the enactment of GO 23.

    The Philippines’ Department of Trade and Industry (DTI) is urging tobacco companies to manufacture their heated tobacco products in the country, citing surging domestic demand and export opportunities, according to the Philippine News Agency.

    During the International Tobacco Agriculture Summit in Taguig City on Aug. 2, DTI Undersecretary Ceferino Rodolfo said while local demand for cigarettes is expected to decline from 49.61 billion sticks in 2022 to 39.06 billion sticks in 2027, sales of HTPs are poised to increase significantly during that period.

    He cited a Euromonitor predicting HTP retail sales of HTPs to surge by 511 percent to 4.06 billion sticks in 2027.

    Rodolfo said HTP producers would benefit the Philippines’ free trade agreements with regional markets. “HTPs, if manufactured in the Philippines, can be imported in ASEAN (except Vietnam), Australia, New Zealand, Japan, Korea, and Hong Kong at zero percent tariff duty,” he was quoted as saying.

    In 2022, the top destinations for Philippine tobacco products included South Korea at $102.2 million, Thailand ($98.29 million) and Myanmar at $49.4 million.

    According to Rodolfo, Philip Morris Fortune Tobacco aims to build a PHP9-billion factory in Tanauan, Batangas, for the production of IQOS devices.

    The High Court of Justice in London ruled April 17 that Philip Morris Products’ (PMP) patents protecting a tobacco-heating technology are valid, reports Law360. The ruling represents a defeat for BAT and its Nicoventures subsidiary, which had sought to revoke PMP’s patents.

    While considering the patent valid, the court also said that BAT’s Glo heated-tobacco products did not infringe the patents, heading off an infringement counterclaim filed by PMP.

    The April 17 ruling is the latest chapter in an ongoing intellectual property dispute between the tobacco giants.

    PMP initially sued BAT and Nicoventures, claiming they infringed several of its tobacco-heating technology patents. This prompted BAT and Nicoventures to file counterclaims seeking to invalidate the patents.

    The proceedings have now branched off into several different actions before the High Court.

    In the current case, Nicoventures argued, among other things, that the PMP technology was obvious in light of a 1998 patent application referred to as “Pienemann,” which covers a “system for providing an inhalable aerosol.”

    While Pienemann, like PMP’s technology, has multiple heating elements, Judge Michael Tappin said that a skilled team would consider the multiple heaters to “mimic” one heater. Pienemann also did not specify the inclusion of a thin-film heater as seen in the PMP patent, instead describing a “graphite loaded sheath,” according to the judgment.

    Regarding the infringement claim, Tappin said that BAT’s Glo products did not infringe the patents because they did not include a method of allowing different parts of the heating system to be heated at different times.

    Taiwan Tightens Rules, Boosts Fines for Vaping

    The National Police Agency confirmed to Taiwan News on Thursday that police can now issue on-the-spot fines of up to NT$10,000 ($330) to those caught vaping after Taiwan’s legislature passed amendments to Taiwan’s Tobacco Hazards Prevention Act on Wednesday.

    E-cigarette users can either be fined on the spot, or photo and video evidence can be used by the government to send the fines to violators’ registered addresses, similar to fines currently issued for smoking in non-smoking areas, jaywalking, and other minor offenses.

    The fine for vaping is now the same as for smoking in areas designated as non-smoking, between NT$2000 and NT$10,000.

    The amendments passed on Wednesday also increase the legal age for purchasing cigarettes from 18 to 20, and prohibits the sale of e-cigarettes and heated tobacco products. Importers, manufacturers, and sellers can now be fined up to NT$50 million.
